Federal Judge: Students' Raunchy Facebook Photos Are Protected by First Ammendment

Federal Judge: Students' Raunchy Facebook Photos Are Protected by First Ammendment: "A federal judge in Indiana has ruled that students who posted photos of themselves with penis-shaped lollipops on social networks should not have been punished by their school.

“Not much good takes place at slumber parties for high school kids, and this case proves the point,” begins the opinion by the Fort Wayne division of the U.S. District Court, which ultimately ruled that the photos were protected by the first amendment.

It was at several sleepovers where the students, two 10th-grade girls, took photos of themselves with the lollipops and in other fully clothed suggestive positions. They then posted those photos on Facebook, Myspace and Photobucket. When the principal of the high school was alerted to the photos by parents, he suspended both girls from the Volleyball team for violating the school’s extracurricular code of conduct."

Judge Says No to Facebook Debt Collector

Judge Says No to Facebook Debt Collector: "Debt collector stalking you on Facebook? Melanie Beacham says it’s harassment and took debt collector MarkOne Financial to court, trying to get the company to stop sending her Facebook messages about the debt she owed. The company also allegedly sent such messages to everyone else on her Facebook friends list.

Behind on her car payments, Beacham started receiving as many as 23 calls per day from MarkOne Financial before it found her on Facebook, according to the Orlando Sentinel. A Florida judge put a stop to the phone calls and online messages in a preliminary ruling, barring the debt collector from calling her or from contacting her, family or Facebook friends."

Judge Hits Blogger with $2.5 Million Charge for Not Being a Journalist

Judge Hits Blogger with $2.5 Million Charge for Not Being a Journalist: "In a case that’s sending a frightening message to the blogger community, a U.S. District Court judge ruled that a blogger must pay $2.5 million to an investment firm she wrote about — because she isn’t a real journalist.

As reported by Seattle Weekly, Judge Marco A. Hernandez said Crystal Cox, who runs several blogs, wasn’t entitled to the protections afforded to journalists — specifically, Oregon’s media shield law for sources — because she wasn’t “affiliated with any newspaper, magazine, periodical, book, pamphlet, news service, wire service, news or feature syndicate, broadcast station or network, or cable television system.”

The Obsidian Finance Group sued Cox in January for $10 million for writing several blog posts critical of the company and its co-founder, Kevin Padrick. Obsidian argued that the writing was defamatory. Cox represented herself in court."

Is This An Alien Spacecraft Parked Next to Mercury? - KOMPAS.com: "KOMPAS.com - A gigantic object the size of a planet has appeared on astronomers screens lurking near Mercury, with UFO hunters around the world wondering whether it’s an alien ship.

The object appears from nowhere in a sequence of images of a coronal ejection from the Sun, taken by a Nasa telescope.

As the flare races past Mercury, a huge round object appears next to it – but Nasa scientists insist that the object is merely a result of the way the images are processed.

Over 100,000 YouTube users have watched the sequence taken by the Heliospheric Imager-1 telescope."

Judge denies Apple request for U.S. ban on Samsung gadgets | Mobile - CNET News

Judge denies Apple request for U.S. ban on Samsung gadgets | Mobile - CNET News: "In the ongoing global patent battle between Apple and Samsung over smartphones and tablets, a U.S. judge has denied Apple a preliminary injunction that would have temporarily prevented Samsung from selling four of its devices in the United States.
In a ruling issued late Friday, U.S. District Judge Lucy Koh decided that allowing Samsung's Galaxy S 4G, Infuse 4G, Droid Charge, and Galaxy Tab 10.1 devices to remain on sale would not harm Apple enough to justify the injunction. She also said such an injunction would likely benefit other gadget makers at Samsung's expense.
In an around-the-world-in-80-lawsuits scenario, Apple has been arguing that Samsung's products infringe its design patents and copy the iPhone and the iPad. Samsung, meanwhile, has fired back with its own patent-related claims against Apple. In addition to the U.S., the battle has touched down in Australia; the Netherlands; Germany; parts of Asia, and France and Italy; among other places."

How Intel helps fund PC makers' marketing: Q&A | Nanotech - The Circuits Blog - CNET News

How Intel helps fund PC makers' marketing: Q&A | Nanotech - The Circuits Blog - CNET News: "In the wake of a report this week that Intel is giving PC makers a $100 subsidy on ultrabooks--which Intel promptly denied--I asked longtime chip guru Nathan Brookwood how Intel's co-marketing works.
Brookwood is the principal analyst at Insight 64. Before becoming an analyst, he held marketing management positions at companies such as Micronics, Intergraph, and Digital Equipment Corporation.
Q: How does Intel's Market Development Fund work?
Brookwood: When they do these MDF programs, it's not a cash subsidy. It's usually done in the form of some cooperative advertising and other promotions. It's not "we'll give a hundred bucks for every system you sell." It's "we'll match a hundred dollars in advertising." That's the essence of the Intel Inside program."

Intel 'Ivy Bridge' chip lineup outed--report | Nanotech - The Circuits Blog - CNET News: "Ivy Bridge, for the uninitiated, is Intel's next-generation processor technology that will feature improved graphics silicon, built-in support for USB 3.0, and Intel's 3D transistor technology, among others goodies.
Here's what CPU World says about the new chips due to be announced in the CES 2012 timeframe: "The third generation Core i7 processors will integrate 4 CPU cores, 8 MB L3 cache and have Hyper-Threading and Turbo Boost technologies enabled."
(Translation: Hyper-Threading, roughly speaking, acts like a virtual processor core. So, a four-core chip would have an extra four virtual cores, for a total of eight. Intel describes Hyper-Threading as "enabling multiple threads to run on each core." Turbo Boost speeds up or slows down individual cores to meet performance or power efficiency needs, respectively.)"

Carrier IQ analysis finds no evidence of 'keylogger' | Privacy Inc. - CNET News

Carrier IQ analysis finds no evidence of 'keylogger' | Privacy Inc. - CNET News: "A Linux kernel hacker who completed an in-depth analysis of Carrier IQ's controversial software has determined that it's incapable of recording keystrokes or perusing SMS messages and e-mail correspondence.
Dan Rosenberg, who has discovered more than 100 vulnerabilities in the Linux kernel, FreeBSD, and GNU utilities, published a blog post last night that analyzed the data Carrier IQ collects and transmits on a Samsung Epic 4G Touch. He found that contrary to what a slew of initial -- and erroneous -- reports claimed, the Carrier IQ software is not a keylogger and "cannot" be configured as one.

"CarrierIQ cannot record SMS text bodies, web page contents, or email content even if carriers and handset manufacturers wished to abuse it to do so," Rosenberg concludes. "There is simply no metric that contains this information." (See CNET's FAQ, related articles, and a list of removal apps.)"

Apple's secret code names for iOS revealed | Technically Incorrect - CNET News: "Sometimes, it seems that Google is just much more imaginative than Apple.
Well, when it comes to naming operating systems, that is. Google offers the sweet inducements of Ice Cream Sandwiches and Honeycombs.
Apple, on the other hand, seems to cling to a certain BMW-ness-- just a few letters and numbers and there you have it.
I am about to turn that world view upon its nostrils. For, thanks to the Cult Of Mac, I have received wind that Apple keeps its cute little code names clutched to its secretive bosom."

Intel to help more companies build ultrabooks | Nanotech - The Circuits Blog - CNET News

Intel to help more companies build ultrabooks | Nanotech - The Circuits Blog - CNET News: "Intel will step in to help smaller companies build ultrabooks, as the chipmaker continues its push to make the new supper-skinny laptop category a success, CNET has learned.
With the goal of getting smaller PC makers to supply branded ultrabooks, Intel will hold a meeting Wednesday in Taipei as a "matchmaker" between large device manufacturers--so-called ODMs or original design manufacturers--like Foxconn, Pegatron, Compal, and Quanta and smaller brands, according to an industry source familiar with Intel's plans.
The list of prospective ultrabook brands will include companies like Epson, Onkyo, Viewsonic, Mustek, Motion Computing, WiPro, and Positivo, according to the source. While some brands, like WiPro and Positivo, are not well known, they are big players in regional markets.
Smaller brands don't necessarily have the wherewithal to build ultrabooks, according to the source. The biggest brands, like Hewlett-Packard, Dell, Acer, Asus, and Toshiba, are already supplying or readying ultrabooks and are not the focus in this case."

America's army of jobless - latimes.com

America's army of jobless - latimes.com: "When President Obama announced that 40,000 troops now in Iraq would come home by the end of the year, the initial excitement quickly turned to concern that our already struggling economy couldn't easily handle the shock of an additional 40,000 job seekers.

Although we should, of course, care deeply about returning Iraq war veterans, we ought not to think for a moment that adding 40,000 workers to the job-seeking pool will break the back of the economy. It's already broken. The nation is laboring under the weight of a reserve army of nearly 27 million women and men who don't have a full-time job, but most surely want one."

Michael Kinsley: The right answer? 'I don't know' - latimes.com

Michael Kinsley: The right answer? 'I don't know' - latimes.com: "A year ago, 27% of those polled nationwide said they agreed with the tea party, and 22% said they disagreed. Last month, according to the Pew Research Center for the People and the Press, it was the reverse: 27% said they disagreed with the tea party, and 20% agreed.

If the tea party folks are feeling a bit paranoid about the abundant publicity this poll got when it was released this week, they have some justification. A 5- to 7-percentage-point swing over the course of a year is hardly the stuff of counterrevolutions. But it's not that the news media are biased against the tea party. We love the tea party; it's been good to us. Rather, we are biased in favor of change. The story must evolve, even if that means moving backward and repeating itself. Having built the tea party up, it is now our job to knock it down a peg or two. And the Occupiers shouldn't gloat. They're next."

Gingrich practices the fine art of political pandering - latimes.com

Gingrich practices the fine art of political pandering - latimes.com: "Sure, it's a time-honored practice -- for candidates of both parties.

But it's always a bit, oh, disappointing. And especially coming from a candidate who says he's determined to offer "serious leadership doing serious things" as president.

But here it is:

Republican presidential contender Newt Gingrich, whose plan to give permanent residency to illegal immigrants has angered some conservatives, signed a pledge Thursday to build a double fence along the U.S.-Mexico border by the end of 2013.

"We haven't been able to build a fence on the border because we have not been a serious country," said Gingrich, as he prepared to sign the pledge following a morning speech to employees at Nationwide Insurance in Des Moines."

The American century: That was then - latimes.com: "If you want a gauge of an America on the downward slope, you could look at the recent poll commissioned by the newspaper the Hill, in which a startling 69% of respondents said they considered the country to be in decline. Or you could just consider the soaring language of this season's presidential candidates. Mitt Romney, in a recent Republican debate on foreign policy, was typical, insisting that "this century must be an American century" in which "America leads the free world and the free world leads the entire world.""

What's so awful about the 1%? - latimes.com

What's so awful about the 1%? - latimes.com: "The class war is on. It's the 99% of "us" versus the 1% of "them."

In the rhetoric of this war, we are fighting the 1% because they possess most of the nation's wealth, bankroll their handpicked political candidates, control the banks and get million-dollar paychecks and billion-dollar bailouts; yet they don't pay enough taxes or invest their wealth in creating American jobs. They're the "millionaires and billionaires" President Obama has called out as needing to pony up more for progressive reforms of our healthcare, banking, tax and political systems. They are the enemy of "us" — the 99% who toil at low-wage jobs, hold underwater mortgages, face foreclosures, suffer recurrent and protracted job layoffs and plant closings, and yet pay our fair share of taxes."

Common-sense advice for Congress - latimes.com

Common-sense advice for Congress - latimes.com: "With Congress lurching toward adjournment after a year rich in drama but poor in accomplishment, lawmakers have to decide whether to renew a handful of tax and spending measures that could have significant effects on the economy. Their job is complicated by the uncertain state of the recovery; although the housing market remains grim, there are hints in other sectors that the economy is gaining steam. We think it's too early yet for Congress to stop trying to stimulate growth, but Washington still needs to be smart about how it does so. And some of the proposals coming out of the White House and Capitol Hill don't pass that test."
